1. Purpose of Policy

This Privacy Policy applies to the collection, use, disclosure and handling of personal information by Lawmee Pty Ltd (“Lawmee”), including but not limited to personal information collected via the Lawmee application, website, using our services and interacting with our team.

We are committed to protecting the privacy of individuals and are bound by the Australian Privacy Principles set out in the Privacy Act 1988 (Cth) (Act). We will only collect, use or disclose personal information in accordance with the Act and this Privacy Policy.

2. Personal information – types of information we collect

Personal information is any information about you which can be used to identify you. This may include information about you as a person, your devices, payment details, and information about how you use a website or online service.

Personal information/data we collect depends on the services we are providing to you and may include, amongst other things:

• Contact information: name, phone number, email, location;
• Application data: proof of identity details, languages spoken, geographic area, qualification details;
• CV information: work history, educational history, references, other skills, admission details;
• Candidate profile: candidate photo, notes on candidate, references and ratings; and
• Employment data: proof of right to work details, bank details, relevant tax and superannuation information, emergency contact details, timesheets, invoices and other relevant information; and
• Other interactions with our platform, online presence or team.

3. Collection of information

Lawmee collects personal information from you in a number of different ways, including directly from you or in the course of our dealings with you or from other sources such as LinkedIn. Some of the times we may collect personal information from you may include:

• When you register for an account or enquire about a service;
• Interacting with our team;
• Signing up to receive updates from us via email, newsletter or social media channels;
• Using a mobile device or web browser to access our website or content;
• Contacting us via email, phone, in person, social media, or on any similar technologies; and
• When you interact with or mention us on social media.

If you provide us with personal information about someone else, you must always ensure you are entitled to disclose that personal information to us, such that we may collect, use and disclose that personal information in accordance with this privacy policy without taking any further steps, and that you make such person aware of the contents of this privacy policy.

If you engage our services or have a relationship with our clients or are a counterparty to our clients, we may hold personal information you or our client or a third party provides to us. We may use this information for the purpose of providing our clients with our services. Due to the services we perform for our clients, we may hold personal information about you, which we have received from a client, without obtaining your direct consent.

4. Use and disclosure

Lawmee may collect, hold, use and disclose information for the below purposes and in accordance with Australian law, such as:

• to provide you with our website and App core features and services;
• to consider your employment application or job opportunity;
• to manage our relationships with lawyers, paralegals and clients and service providers;
• to customise or personalise your experience of our website or App;
• to contact and communicate with you and analyse data and metrics;
• to market you to law firms and other companies that might be interested in a placement;
• to market your opportunity to lawyers and paralegals who might be interested in your law firm or company;
• to offer you appropriate work with law firms and companies;
• to set up invoicing and payroll and related services;
• to improve our placement services involving business intelligence, system development and testing;
• proactively send you suitable lawyers, paralegals, opportunities, newsletters and other information we think may be relevant;
• to share industry information with you and invite you to events;
• to promote Lawmee to our clients and individuals who may be interested in our services either for the business with which they are associated or personally and to provide them with information about developments, events or other products or services that may interest them, by way of direct marketing and otherwise;
• in the course of providing our services and for internal record keeping and administrative purposes;
• to facilitate our business operations, including to fulfil our legal requirements, to provide customer support, to support and manage our employees, to protect our property, to prevent and investigate crime or possible crime, and to provide information to external service providers so that they can provide financial, administrative or other services in connection with the operations of our business; and
• to communicate with others for one or more of those purposes.

Other instances in which we may use and disclose your personal information include:

• in confidence, to our advisers and insurers, accountants, banks, legal outsourcing providers, billing or data storage services, email filtering, virus scanning and other technology services providers, marketing partners, advertising partners, research firms, marketing platform providers (including social media services) and archival services providers;
• in confidence, to third parties to improve our services and obtain feedback; and
• where the use or disclosure is authorised or required by or under an Australian law or court/tribunal order.

Some of the third parties to whom we disclose your personal information may be located outside Australia. For example, we may disclose your personal information to external national or overseas facilities in the course of conducting information and data processing, back up and scanning or for the purposes of obtaining other services from third parties.

5. Reasons for collection

The legal and/or operations basis for collecting and processing your personal information will usually be one of the following:

• where provided by you or with your consent;
• evaluating your suitability for an opportunity with our clients;
• evaluating your opportunities, law firm or company for our lawyers and paralegals;
• to perform an obligation under a contract with you or a relevant client or party;
• the legitimate interests in operating our business, which includes recruitment whether as an employee or contractor, dealing with your requests and enquiries via our site or when dealing with a member of the Lawmee team, providing services to clients, inviting you to Lawmee or our client events, conducting research and analysis to help us improve our services for our valued lawyers and clients; and/or
• to comply with our legal or employment agent obligations.

6. General log data

When you visit our site, our servers may automatically log the standard data provided by your web browser. this may include, for example, your device’s Internet Protocol (IP) address, your browser type and version, device location, the pages you visit, the time and date of your visit, the time spent on each page, and other details about your visit. Additionally, if you encounter certain errors while using the site, we may automatically collect data about the error and the circumstances surrounding its occurrence. This data may include technical details about your device, what you were trying to do when the error happened, and other technical information relating to the problem. You may or may not receive notice of such errors, even in the moment they occur, that they have occurred, or what the nature of the error is.

This information may not be personally identifying by itself, although it may be possible to combine it with other data to personally identify individual persons.

7. Transaction data

Transaction data refers to data that accumulates over the normal course of operation on our platform. This may include transaction records, stored files, user profiles, analytics data and other metrics, as well as other types of information, created or generated, as users interact with our services.

We may combine voluntarily provided information and automatically collected personal information with general information or research data we receive from other trusted sources. For example, if you provide us with your location, we may combine this with general information about currency and language to provide you with an enhanced experience of our site and service.

8. Security of your personal information

When we collect and process personal information, and while we retain this information, we will protect it within what we deem to be commercially acceptable means to prevent loss and theft, as well as unauthorised access, disclosure, copying, use or modification

We may store your files in hard copy or electronically in our ordinary IT systems. These may include Australian-based cloud servers or the servers of third parties within Australia.

We implement a range of physical and electronic security measures to protect the personal information that we hold. However, you are responsible for selecting any password and its overall security strength, ensuring the security of your own passwords and information within the bounds of our services.

Although we will do our best to protect the personal information you provide to us, we advise that no method of electronic transmission or storage is 100% secure and no one can guarantee absolute data security. We foster a security aware culture.

As a disclaimer, except to the extent liability cannot be excluded due to the operation of statute, Lawmee excludes all liability (including in negligence) for the consequences of any unauthorised access to your personal information whatsoever. Please notify us immediately if you become aware of any breach of security.

9. Your rights and controlling your personal information

Your choice: by providing personal information to us, you understand we will collect, hold, use, and disclose your personal information in accordance with this privacy policy. You do not have to provide personal information to us, however, if you do not, it may affect your use of our website or the products and/or services offered on or through it.

Information from third parties: if we receive personal information about you from a third party, we will protect it as set out in this privacy policy. If you are a third party providing personal information about somebody else, you represent and warrant that you have such person’s consent to provide the personal information to us.

Marketing permission: if you have signed up to our platform or previously agreed to us using your personal information for direct marketing purposes, we may do so, noting you may change your mind at any time by contacting us using the details below.

Non-discrimination: we will not discriminate against you for exercising any of your rights over your personal information. Unless your personal information is required to provide you with a particular service or offer (for example processing transaction data), we will not deny you goods or services and/or charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties, or provide you with a different level or quality of goods or services.

Notification of data breaches: we will comply with laws applicable to us in respect of any data breach.

Be forgotten by us: you can do this by asking us to erase any personal data we hold about you, if it is no longer necessary for us to hold the data for purposes of your use of Lawmee. You will then no longer be able to use our services.

Lodge a complaint: please tell us first, so we have a chance to address your concerns. Lawmee only processes your personal information in accordance with this privacy notice and in compliance with Australian privacy laws. If, however you wish to raise a complaint regarding the processing of your personal information, you have the right to lodge a complaint with the supervisory authority, either by calling their helpline or as directive on their website at www.oaic.gov.au

Unsubscribe: to unsubscribe from our site or email database or opt-out of communications (including marketing communications), please contact us using the details provided in this privacy policy, or opt-out using the opt-out facilities provided in the communication. We may need to request specific information from you to help us confirm your identity.

Access: you may request details of the personal information that we hold about you.

Correction: if you believe that any information we hold about you is inaccurate, out of date, incomplete, irrelevant, or misleading, please contact us using the details provided in this privacy policy. We will take reasonable steps to correct any information found to be inaccurate, incomplete, misleading, or out of date.

10. Business transfers

If we or our assets are acquired, or in the unlikely event that we go out of business or enter bankruptcy, we would include data, including your personal information, among the assets transferred to any parties who acquire us. You acknowledge that such transfers may occur, and that any parties who acquire us may, to the extent permitted by applicable law, continue to use your personal information according to this policy, which they will be required to assume as it is the basis for any ownership or use rights we have over such information.

11. Limits of Our Policy

Our website may link to external sites that are not operated by us. Please be aware that we have no control over the content and policies of those sites, and cannot accept responsibility or liability for their respective privacy practices.

12. Changes to this Policy

The date of this Privacy Policy is set out below. We may change this Privacy Policy at our discretion. By continuing to use the website or App or our services, or otherwise continuing to deal with us, you accept this Privacy Policy as it applies from time to time.

13. International transfers of personal information

Where the disclosure of your personal information is solely subject to Australian privacy laws, you acknowledge that some third parties may not be regulated by the Privacy Act and the Australian Privacy Principles in the Privacy Act. You acknowledge that if any such third party engages in any act or practice that contravenes the Australian Privacy Principles, it would not be accountable under the Privacy Act, and you will not be able to seek redress under the Privacy Act.
